Mozambique’s National Institute for Cultural and Creative Industries (INICC) has proposed the creation of a Legal Framework for Collective Management Entities of Copyright and Related Rights, aimed at strengthening the legitimacy, transparency, and efficiency of organisations that defend the interests of Mozambican creators.
The proposal comes against a backdrop of growth in the number of collective entities operating in the protection of Copyright and Related Rights. According to INICC, this evolution makes it necessary to establish a specific legal instrument with uniform rules governing the formation, organisation, and functioning of these entities.
Among the principal constraints identified are insufficient mechanisms for transparency in the management and distribution of revenues, the absence of effective systems for collecting licensing fees for protected works, and inadequate information provided to rights holders regarding the criteria used to set tariffs and the conditions under which their works may be used.
INICC believes the new legal instrument could help overcome these shortcomings by establishing clear rules for the operation of collective management organisations and ensuring adequate representation of rights holders.
The adoption of the framework is expected to confer greater legitimacy on entities such as the Mozambican Authors Association, the Mozambican Copyright Society, and the Mozambican Society of Authors. The measure is also expected to strengthen the legal protection of creators, promote greater equity in the distribution of revenues, and increase the accountability of collective management organisations.
The proposal draws on the experiences of countries including Malawi, Angola, Kenya, Cabo Verde, Portugal, and Brazil. The instrument is currently undergoing inter-ministerial harmonisation and consultation with private institutions, cultural associations, arts and culture professionals, and collective management organisations operating in Mozambique.
The process is grounded in Law No. 9/2022 of 29 June, the Law on Copyright and Related Rights. Article 93 of that law establishes that powers relating to the management of such rights may be exercised directly by rights holders, through duly authorised representatives, or through Collective Management Organisations licensed by the competent authority responsible for the culture sector.
With the new framework, INICC aims to create a specific legal structure for the operation of collective management organisations, addressing the key constraints identified and reinforcing the protection and management of the rights of Mozambican creators.
